Supreme Court Refuses Atiku’s Application To Add Fresh Evidence

The Supreme Court has told Atiku Abubakar of the Peoples Democratic Party that the 180 days allowed for fresh evidence is immutable.

 

It said the appellants failed to file fresh documents they later claimed they had within the 180 days provided by law for the hearing at the lower court.

 

Atiku is seeking to nullify President Bola Tinubu’s election at the Supreme Court where the matter will be decided today (Thursday).

 

However, on the application to add fresh evidence, the court ruled, “The application is hereby refused and therefore dismissed.”

 

It described the 180 days as immutable, saying the “appellants did not even apply for an extension of time to add the depositions.”

 

It added that even if they did, it would not have been granted as the matter is grounded in law.

 

The apex court said it is designed to speed up the hearing of petitions.

 

“There cannot be an addendum,” the court said.

 

It noted that in their petition, “There is no paragraph to accommodate the case of forgery,” adding that the appellants failed to say why they waited until the 180 days lapsed.
